1. Acceptance of Terms
By accessing or using ColorBestie ("the Service"), you agree to be bound by these Terms & Conditions. If you do not agree to these terms, please do not use the Service.
2. Description of Service
ColorBestie is a mobile application and web service that generates alcohol-marker color reference previews from uploaded sketches and photos using artificial intelligence. The Service requires a paid subscription or credits to generate previews.
3. Account Registration
To use the Service, you must create an account by signing in with Google, Apple, or email. You are responsible for maintaining the security of your account credentials. You must be at least 13 years of age to use the Service.
4. Subscriptions, Prices, and Payments
ColorBestie offers weekly, monthly, and yearly paid subscriptions. Prices shown on ColorBestie are inclusive of VAT unless explicitly stated otherwise. Before checkout, the selected plan, billing period, included credits, renewal information, and available payment methods are shown.
- Weekly and monthly subscriptions include credits that reset each billing period and do not roll over.
- Yearly subscriptions include a yearly upfront credit grant.
- Additional credit packs can be purchased separately by active subscribers as one-time purchases.
- Subscriptions automatically renew for the same billing period unless cancelled before the next renewal date.
- You can cancel your subscription via your account, the applicable app store, or by contacting support.
- For web subscriptions paid by recurring direct debit or another recurring MultiSafepay method, you authorize Raved Fabrics / ColorBestie to collect the recurring subscription amount for the selected billing period until cancellation.
- We will inform you about recurring collections before they take place. If SEPA direct debit is used, we will send this pre-notification at least 14 days before the first and following collections unless a shorter legal or payment-scheme period is allowed.
- Web payments are processed securely through MultiSafepay. App purchases are processed by Apple App Store or Google Play where applicable.
- Refunds are handled according to our Refund Policy, MultiSafepay rules, and the applicable app store policies.
5. Recurring Payment Mandate and Cancellation
By starting a web subscription, you agree to the selected recurring plan, price, billing period, included credits, and automatic renewal shown before checkout. Recurring payments are collected for the same billing period until you cancel.
You can cancel future renewals from your account where available, or by contacting us via contact@joostheijden.com or +31 6 57 45 27 23. After cancellation, we stop future recurring collections. Cancellation does not automatically refund payments already processed.
If a payment method requires a signed or accepted mandate, your checkout confirmation and acceptance of these terms are used to record your recurring-payment authorization. We may retain mandate and checkout records for as long as required for payment processing, dispute handling, and legal compliance.
6. Credits, Usage, and Immediate Digital Delivery
Each image generation consumes one credit. Credits are granted upon subscription activation or purchase. Unused credits from subscription periods do not carry over unless otherwise stated. Credit balances are non-transferable and non-refundable.
ColorBestie is a digital service. When you complete checkout, you request and agree that access to the digital service and credits starts immediately. Because delivery starts immediately, your statutory withdrawal right for digital content/services may end once the service has started, where permitted by law.
7. User Content
You retain ownership of all images you upload to the Service. By uploading content, you grant ColorBestie a limited license to process your images for the purpose of generating color previews. Generated previews are stored in your account and can be deleted at any time.
You agree not to upload content that is illegal, offensive, or infringes on the rights of others.
8. AI-Generated Content
Color previews are generated using artificial intelligence (Google Gemini AI). Results are approximate and intended as creative references only. ColorBestie does not guarantee the accuracy of color matching or the suitability of generated previews for any specific purpose.
9. Third-Party Services
The Service integrates with the following third-party providers:
- Google Authentication — for account sign-in
- Apple Authentication — for account sign-in
- Google Gemini AI — for image processing and color preview generation
- Supabase — for file storage and email authentication
- MultiSafepay — for web payment processing
Use of these services is subject to their respective terms and privacy policies.
10. Intellectual Property
The ColorBestie name, logo, mascot, and all associated branding are the intellectual property of ColorBestie. You may not reproduce, distribute, or create derivative works from any part of the Service without prior written consent.
11. Account Termination
You may delete your account at any time from the Profile page. Active subscriptions must be cancelled before account deletion. We reserve the right to suspend or terminate accounts that violate these terms.
12. Limitation of Liability
ColorBestie is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the preceding 12 months.
13. Changes to Terms
We may update these Terms & Conditions from time to time. Continued use of the Service after changes constitutes acceptance of the updated terms. We will notify users of significant changes by posting the updated terms on this page.
14. Governing Law
These terms are governed by and construed in accordance with the laws of the Netherlands. Any disputes shall be resolved in the competent courts of the Netherlands.
